His Highness Prince Karim Aga Khan denies Justice to Khalid Memon despite several appeals. Is it because Your Highness is only interested in Justice when your own house or business are not involved? Has Justice been denied to Khalid because you own Habib Bank? It seems apparent that you Believe in Justice considering your statements and your speeches and your websites which clearly state ‘AKDN agencies conduct their programmes without regard to faith, origin or gender’. Saying is fine, but doing it is another. It takes courage to admit faults within yourself and His Highness is surely courageous. So what is the reason for this denial and delay?

Now that it has been proven beyond any doubt that the actual perpetrators ‘Dhani Bux Jatoi and Burzin Pajnigara’ through their counsel have admitted in writing that they are mutually responsible for the loan and have given an undertaking to the Banking Court that they shall pay the Agricultural Loan, Khalid Memon stands vindicated. Habib Bank has committed fraud and have forged Khalid’s signature on the Bank Loan documents which is a crime and carries a 7 year jail sentence. To prove his innocence and tell the facts as they were, Khalid sent letters to the Aga Khan Secretariat, registered email to Habib Bank head office, emails to Prince Karim and Prince Amyn Aga Khan , the Press Attaché Aga Khan Secretariat in France, emails to AKDN and AKFED with references to website blog but all in vain. Habib Bank lawyers on the instructions of their employers and the owners (AKFED) insisted till the last moment that Khalid Memon was the culprit and should be punished. It was only under immense pressure that the Jatoi’s decided to tell the truth. It has taken Ten long torturous years for Khalid Memon to prove his innocence. Your Highness it is about time you showed how great a leader you really are and grant me JUSTICE. If not, then all your speeches and words are just that and amount to nothing.

Gloom Sets in Habib Bank's Legal Camp - Court Reporter: The Honourable Judge of the Banking Court II, Hyderabad, dealt a blow to Habib Bank's plan to Re-Auction Khalid Memon's property. Arguments presented by Legal Counsel for Khalid Memon, Mr. Ishaq Qureshi Advocate were strong and convincing enough and the Honourable Judge has issued notices to HBL to produce the Real Guarantors Mr. Bashir Lehri (c/o Dhani Bux Jatoi) and Mr. Barzeen Pajnigara before the Banking Court and inquired whether HBL had ever issued notices to the two. If notices were in fact issued by Habib Bank and the two Guarantors had not turned up, did the Bank report this matter to the Court for Arrest Warrants and why were the two Actual Guarantors not declared absconders. Gloom set in after the verdict of the Honourable Judge and Habib Bank camp was in total disarray. Now Habib Bank has decided to issue legal notice to Bashir Lehri through Dhani Bux Jatoi and Barzeen Pajnigara through the Pakistani Consulate in Canada.

Email to Press Attaché at 'information@aiglemont.org’ Respected Sir I have sent repeated emails to your Press Attaché and have made appeals on the Internet through various channels including Scribd, Feedmap, etc., and have humbly pleaded for the resolution of the matter of Habib Bank Agricultural Loan Fraud. Your Highness believes in Justice for all, irrespective of colour, gender, culture or creed.

Why is it, Your Highness, that I am being treated differently? Is it because you own Habib Bank and that makes it personal? You know very well what Habib Bank have done to me for the past 9 years. Time and time again, I have proved beyond any doubt of the wrongdoings of Habib Bank Limited Pakistan. Can you still allow this to go on? Is this Justice?

If Habib Bank has done nothing wrong and I am truly a Guarantor and a Defaulter, why are Habib Bank Staff reluctant to show the ORIGINAL loan documents to the Court or my Solicitor to prove us wrong and that would be the end of the case? It is well known that His Higness the Aga Khan believes in Justice for all, regardless of their gender, origin or religion.

Barzeen Pajnigara, son of Minoo and late Silloo Pajnigara (Karachi), married Parivash Kadkhodai, daughter of Jamshed and Mehroo Kadkhodai (Mumbai, India) Mississauga, ONT on October 29, 2006. Mrs. Parivash Pajnigara is a practicing doctor in Canada and a partner in S M Trading House Inc., where she also does business and regularly holds exhibitions of Hand painted t-shirts, bed sheets, table cloth and towels.

As such, Barzeen Pajnigara, being the main Guarantor in the above Agricultural Loan and also being a partner in the same land with a holding of about 200 acres and more than capable of paying off the entire loan, should be brought to task in the name of Justice. It is time that Habib Bank changes its present immoral and unethical course of victimizing Mr. Khalid Memon and going after the real culprits. This would be the righteous thing to do.

This information is not relevant to the case but it shows the low moral values of Barzeen (Burzin) Pajnigara. He has still not paid for goods imported by him on credit from a friend and benefactor’s company in the UAE. If Barzeen can steal from a long time friend, supporter and benefactor, what is he capable of, if you are not his friend?

Habib Bank Auction Notice of Khalid Memon's land is Illegal

• My client sent a notice to Dhani Bux Jatoi and Burzin aka Burzeen/ Barzeen Pajnigara via Registered Post & Courier on 6 March 2007 regarding the cancellation of the informal agreement due to repeated payment defaults for sale of 170-34 Acres (Machol Lake), the same land that was to be auctioned by Habib Bank Limited.

• When my client received the acknowledgement due receipt from Dhani Bux Jatoi for the above notice but NO REPLIES, he hired an advocate Mr. Abdul Qayyum Abbasi from Karachi who sent legal 7 day notices to both Dhani Bux Jatoi and Barzeen (Burzin) Pajnigara on 10 Sep. 2009 claiming immediate payment and damages against the purchase of Khalid Memon’s Share of the land.

• Once again, no replies were received nor any objections raised by Dhani Bux Jatoi and or Barzeen (Burzin) Pajnigara. • In continuation to the Legal Notices by Registered Post & Courier to Burzin Pajnigara and Dhani Bux Jatoi by Abdul Qayyum Abbasi, legal counsel for Khalid Memon dated 10 Sep 2007, to which no replies were received, my client’s previous advocate issued a Public Notice Letter to Daily Kawish for publication.

• A Public Notice was published in Daily Kawish 23 Sep 2007.

• This notice was with regards to ownership of the land, cancellation of the informal sale agreement and if anyone had any objections or claim to the land, they should reply within 7 days and the advocates address.

• Dhani Bux Jatoi and Burzin Pajnigara have failed to reply to these notices to date and no objection of any kind whatsoever have been received to date from any person (s). This is the same land that Habib Bank wants to auction.

Mr. Abu Baker Shaikhani, a reputable businessman of UAE was a witness to the whole proceedings and even signed the informal agreement as a witness. This is also the same land that you, Habib Bank Limited, wanted to auction by forging loan documents showing my client as a Guarantor and showing Jatoi’s as the owners, whereas the true and proven facts are completely reverse. My client is not a Guarantor but he is the legal owner of the above mentioned land.

Anyway, due to lack of faith in your ability and keeping in mind your vested interests, we have already started our own proceedings against Mr. Barzeen Pajnigara by informing the Canadian Authorities and by hiring a lawyer through “Legal Aid Ontario”. Naturally costs would be incurred in such matters which would be claimed from your bank when the matter for defamation and damages goes to High Court.

Barzeen Pajnigara has again swindled and conned another friend and most of all a person who has always helped him in times of need and desperation and whom he repeatedly called his Savior and Benefactor. A Plea with documented proof has been filed in the Banking Court II, Hyderabad, to call in Mr. Dhani Bux Jatoi, resident of House No. A-14, Park View, Phase I, Qasimabad, Hyderabad, the actual beneficiary of the Controversial HBL Loan and a very important witness and party to the whole sordid affair in which his Late father friend and partner, Mr. Khalid Ahmed Memon, whom he repeatedly calls "Uncle" was cheated, defamed, defrauded, threatened, blackmailed and harassed by Dhani Bux to keep quiet about the whole affair as at that time his real Uncle Mr. Liaquat Ali Khan Jatoi was the Chief Minister of Sindh and later the Federal Minister for Water & Power. Habib Bank Enticement results in Banking Court Stalling Case Decision

Habib Bank staff hoodwinked the Banking Court for 8 years and have partly succeeded in their nefarious intentions of influencing the Banking Court to dismiss the case as it is time barred. My lawyer had presented latest Supreme Court rulings where it is clearly stated that in case of any inclination of fraud and forgery committed or any controversy or suspicion about any case , the case must be heard, issues framed and witnesses called. The Honorable Judge did verbally agree to admitting the case and gave a definite date to Khalid Memon's Lawyer for passing the order on April 7, 2009. The Honorable Judge would also order Habib Bank to provide original loan documents to the court for forensic examination. Khalid Memon's Lawyer totally convinced the Honorable Judge by presenting latest Supreme Court 2002 Rulings which superseded Habib Bank's time barred rulings of 1992 and 1997. Since then, Habib Bank Top Brass, who were worried sick over the decision, decided to play dirty and managed to influence the Banking Court Judge, who has stopped attending Court and is dillydallying and evading the issue. Unfortunately the Honorable Judge has been compromised and has to date not issued the order.

Sind Motors Gasoline Station (Petrol Pump) account with HBL District Council Branch, Hyderabad, Loan taken in 1992 from Habib Bank Limited, Hyderabad after mortgaging the Petrol Pump 3. Khalid Memon still appears as Legal Partner of the said premises and is obligated to pay the loan.....

Khalid Memon has never signed any kind of Habib Bank Agricultural Loan Agreement Documents as a GUARANTOR. Period.

Khalid Memon would spare no expense to have the Habib Bank Original Loan Documents thoroughly checked and if needed, send these abroad for radiocarbon dating and other Document forgery Forensic Science Experts. It is pertinent that the Original Loan Documents were prepared in 1995, nearly 14 years back. As such, if the original documents are for example done away with and replaced by newly prepared ones, it would be quite easy to establish the exact dates the new ones were prepared. As indicated above, there are several tests to ascertain the authenticity of the documents in question. But if the original documents have been tampered, that too, can be ascertained. Khalid Memon has never signed any kind of Habib Bank Agricultural Loan Agreement Documents as a GUARANTOR. Period.

It has been learnt from reliable sources that Habib Bank may decide to Auction the property of Burzin Pajnigara viz. House No. 36, Parsi Colony, General Richardson Road, Karachi to recover their Agricultural Loan as Burzin, aka Burzeen aka Barzeen Pajnigara is the main Guarantor in the Loan. This may be due to the fact that the Auction of the Land was postponed on the day of the Auction and there is hope for justice as the evidence against the culprits is overwhelming.

His past must be scrutinized by an agency and the Canadian immigration should enquire as to why he has used three different spellings of his first name.....

A few months back, I visited Machol farm and found it to be grossly mismanaged by Dhani Bux Jatoi (DB) and his equally useless staff. I sent a letter by courier to DB and his uncle Zafar Jatoi via courier about the state of affairs, a copy of which can be viewed under correspondence. Not only was the farm mismanaged, but Dhani Bux had not paid his staff salaries for 4 months. Worst still, he had blackmailed and hoodwinked the old farm manager Master Ahmed Mallah to pay the farm expenses and to date still owes him 2 hundred thousand rupees.....

Daily Juraat Newspaper - Front Page News - Karachi, 19 December 2008 - 'Former Chief Minister Liaquat Jatoi's brothers and nephews (Dhani Bux Jatoi and his partner Burzin Pajnigara in particular) caught red-handed involved in the illegal siege & occupation of 500 Acre Fish Farm in Sujawal, Thatta, in collusion and connivance with Habib Bank Limited (HBL) staff at Sujawal, Thatta and Hyderabad, who altered and forged Loan Agreement documents to falsely implicate Khalid Ahmed Memon as a Guarantor in the loan case. Whereas, the true facts are that Khalid Ahmed Memon is a partner in the Fish farm and owner of the land which the Habib Bank Loan Recovery Department tried to Auction, with the proceeds going to the Jatoi's instead of the rightful owner'.....
